PLANNING CONSULTANCY SERVICES

DEVELOPMENT FEASIBILITY STUDIES |
Initial scheme positioning, formulation of development strategies, site and feasibility analyses, scheme planning assessments, site assessments, legal checks and work on initial scheme designs are all part of our core skills. Scheme positioning (as we call it) includes writing up design briefs for the architect and undertaking pre-application negotiations with the Local Planning Authority.

SCHEME FORMULATION & DESIGN INPUT |
We are not passive town planners who take on a scheme as designed by the architect. We see ourselves as playing an integrated design role and therefore will always heavily input into the scheme formulation stage. Indeed, we can point to numerous schemes where our design ideas have helped improve a project and get planning permission. If instructed on your proposal we will adopt the very same approach, especially if your scheme has already been presented to the Council and problems have arisen.

PLANNING, DESIGN & ACCESS STATEMENTS
|
In August 2006 a new requirement came in for most planning applications to be accompanied by a justification called a DESIGN AND ACCESS STATEMENT. We have been preparing these for 20 years, with work involving planning statements and planning policy assessments to support and justify schemes. Our role in preparing each Statement is to provide a client side interpretation of the planning policy that is pertinent to the project, thus ensuring that the sought for permission is obtained.

PRESENTATIONS & SUBMISSIONS |
Submissions of planning applications and Certificate of Lawfulness applications over a 20 year period have given us in-depth knowledge of the UK planning system. Indeed, we are often brought into a project and act as agent for a planning application, rather than the architect doing this. In our experience, we as town planners often carry more 'punch' in the planning application and have thus been very successful in the submissions that we have made over the years.

SUSTAINABILITY APPRAISALS |
Our practice now undertakes assessments of a project's level of 'sustainability', as part of a wider range of services. This is in response to emerging planning policies on SUSTAINABLE DEVELOPMENT and SUSTAINABLE COMMUNITIES. This policy, soon to be contained in the new LOCAL DEVELOPMENT FRAMEWORKS, REGIONAL SPATIAL STRATEGIES and updated GOVERNMENT GUIDANCE will provide a strong foundation for schemes to provide a high standard of sustainable design and construction. It needs to be ensured that any development project should not comprise the environmental resources available for future generations. In particular, energy use and CO2 emissions are being focused on in sustainability assessments. This is currently an exciting area and we are planning to undertake Eco-Homes and energy use assessments, as well as sustainability appraisals on planning applications.

NEGOTIATING SKILLS & PROJECT MANAGEMENT |
Core skills include securing schemes by proactive and assertive negotiation, consultant instructions and coordination, negotiation of conditions on planning permission, agreeing section 106 obligations, management of projects within defined timescales and overseeing the build phase.

ADDRESSING PROBLEM SCHEMES |
One of our main roles is to get problem schemes back on track. It is perhaps surprising just how many projects fall into serious problems, with the Council planners either issuing an outright refusal or threatening to do so. In these situations it is our role to positively advise and change the scheme, and then to re-negotiate and re-submit the project. We have been very successful in doing this. ADVISORY RESPONSIBILITIES |
PDK ASSOCIATES advises developer clients, involving optimising the planning-value balance of a scheme, supporting architects in the design process and advising on development strategies. Advice is also given on the planning aspects of investment purchase situations and when difficulties arise in the planning process.

DEVELOPMENT PIPELINE MANAGEMENT |
Much of our work entails not only individual project management but the strategic management of a pipeline of schemes at feasibility and planning application stages. Balancing the opportunities and constraints of a large planning pipeline is one of our strengths. Our aim in development pipeline management is to ensure that a series of planning permissions are achieved on an ongoing basis, with consistency and across a defined timeframe. Ongoing monitoring and review of the planning success rate is an important element of this work.

PLANNING APPEALS & EXPERT WITNESSING |
Planning appeals and enforcement appeals are progressed on a wide variety of projects, by written representations, informal hearing and public inquiry. Peter Kyte has also done advocacy work, which involved cross-examining witnesses at enforcement inquiries. Please see TRACK RECORD for appeal case examples.

SECTION 106 OBLIGATION NEGOTIATIONS |
Planning negotiations often involve negotiating benefits under section 106 agreements. PDK ASSOCIATES has negotiated these with Councils and also unilateral section 106 undertakings have been formulated. Educational contributions on a scheme in Barnet and tree planting and traffic improvements on a scheme in Hounslow are examples of this work. The practice has also been involved in many schemes with section 106 agreements on social housing.

ENFORCEMENT WORK & CERTIFICATE OF LAWFUL DEVELOPMENTS |
Many enforcement appeals have been successfully progressed and Certificates of Lawful Developments obtained for a variety of uses and developments. Two of these involved getting cases published in the Journal of Planning Law.
